LifeCare Plus Program

Please read this document carefully. It contains very important information regarding the Program, including Program requirements, limitations, and exclusions.

GENERAL PROGRAM DESCRIPTION

The LifeCare Plus Program is an exclusive, non-transferable benefit provided to customers who purchase or lease an eligible new vehicle from the Dealership. The Program is not a warranty or a service contract; rather, it is intended to supplement—not to replace—the valuable benefits that factory and purchased warranties and service contracts provide.

Subject to the terms and exceptions discussed below, the Program will make certain covered repairs to the Vehicle (the “Covered Repairs”) that are not covered under the Vehicle’s new car warranty and any extended warranty and/or service contract that you may have purchased for the Vehicle. Your Vehicle will be eligible for Covered Repairs under the Program for as long as you own or lease your Vehicle, follow the factory-recommended maintenance schedule for your Vehicle, and have all such maintenance and other repairs performed by the Dealership.

Electric Vehicles are not Eligible for the Program

The Dealership and its affiliates sell and service various high-quality electric vehicles. However, because their components are sealed, enclosed, and/or require less regular maintenance, electric vehicles are not eligible for Program coverage. Accordingly, no representative of the Dealership is authorized to offer Program coverage for an electric vehicle, and no verbal or written agreement purporting to do so is binding on or enforceable against the Dealership, including this document. If the Vehicle identified above is an electric vehicle, this document is null and void, and the Dealership shall have no liability for any Covered Repairs to the Vehicle. (See COVERED REPAIRS below for information regarding coverage for hybrid vehicles.)

ELIGIBILITY FOR COVERED REPAIRS

To be eligible for Covered Repairs:

  1. The Vehicle must have been purchased or leased from the Dealership as a new vehicle. Used vehicles do not qualify for the Program.
  2. You must have continually owned/leased the Vehicle since you first purchased/leased it from the Dealership. Program coverage is not transferable, and automatically terminates upon the sale, lease termination, or other transfer of the Vehicle from the original purchaser or lessee.
  3. The Vehicle must be up to date on all factory-recommended maintenance and must have received such maintenance in accordance with the factory-recommended maintenance schedule. It is your responsibility to follow the recommended maintenance schedule for your Vehicle, which is typically included in or provided with its owner’s manual and/or service manual. If you have any questions regarding the factory-recommended maintenance schedule for your Vehicle, please contact the Dealership.
  4. All factory-recommended services (including, but not limited to, routine oil and filter changes), maintenance, and wear repair services (including, but not limited to replacing tires, brake components, and the like) must be performed by the Dealership, and all related parts must be purchased From the Dealership. However, the following repairs will not affect the Vehicle’s eligibility for Covered Services if performed by a qualified repair facility other than the Dealership:
      a. repairs that are approved and paid under the Vehicle manufacturer’s new car warranty or any extended warranty and/or service contract covering the Vehicle; and
    b. repairs made in connection with a roadside emergency and/or collision, if such repairs were pre-approved as described under “Making a Claim,” below.

COVERED REPAIRS

Under the Program, the Dealership will repair or replace, at its option and at no cost to you, the following covered parts that malfunction or fail (subject to the exceptions below) and which are not covered by the Vehicle’s manufacturer’s warranty or any extended warranty and/or service contract covering the Vehicle.

Component Covered/Excluded Parts

Engine

  • Engine block, cylinder heads and internal parts including pistons, piston rings and pistons; crankshaft, main bearings, connecting rods and rod bearings; camshaft(s) and camshaft bearings; timing gears and timing chain; rocker arms, shafts and bearings; valves and valve sprints, guides and seats; pushrods and lifters; oil pump, intake manifold and exhaust manifold; water pump; and engine seals and gaskets. EXCLUSIONS: Thermostats are not covered parts but will be repaired or replaced if necessary to effectively remediate the malfunction or failure of another Covered Part.

Transmission

  • Transmission case and internal parts including the torque converter, valve body(s), governor, bands, steel plates, planetary and sun gears, synchros, bearings, supports and shafts; and seals and gaskets. EXCLUSIONS: Standard/manual transmission clutch assemblies and component parts are not covered.

Four-Wheel Drive

  • Transfer case and all internal parts contained with the transfer case; front differential housing and all internal parts, seals and gaskets.

Rear-Wheel Drive

  • Differential housing and all internal parts including parts contained within the differential housing including the ring gear and pinion, gears and bearings (if damaged by the failure of internally lubricated parts); and seals and gaskets.

Hybrid Vehicles

  • Hybrid vehicles are covered for parts and repairs similar to non-hybrid vehicles. Parts that are exclusive to hybrid vehicles including, but not limited to, mild and plug-in hybrid system components, are not covered.

Electric Vehicles

  • Electric Vehicles are not eligible for coverage under the Program.

 

EXCLUSIONS FROM COVERAGE:

The Program does not cover: (1) the repair or replacement of any part that fails or malfunctions due to normal wear and tear, owner abuse, and/or a collision (regardless of fault); or (2) any vehicle that has been used for competitive racing, timed events, auto cross, driver’s school, or hire/commercial purposes including, but not limited to, ride sharing (Uber, Lyft, and the like) and delivery services.

EXCLUDED PARTS:

Examples of parts not covered by this Program include, but are not limited to:

Fuel lines; fuel injectors; fuel pumps; manual transmission clutch parts; harmonic balancer retaining bolts; thermostats; hoses, core/expansion and freeze plugs; carburetors; drive belts; timing belts; automatic transmission and engine oil cooler lines and fittings; any and all linkages; constant velocity joint boots; all front and rear suspension parts including shock absorbers and springs; steering system damper and hoses; all air conditioning system parts including belts, hoses and freon; power brake cylinders, brake rotors and drums; brake pads, linings, and springs; all securing hardware; voltage regulators, distributors, and batteries; body, frame, and interior parts; and mild and plug-in hybrid system components.

MAKING A CLAIM:

All Covered Services must be performed by the Dealership. The Dealership will have no liability for the cost of any repair(s) made at any other service or repair facility, and such repairs will terminate the Vehicle’s eligibility for the Program, unless, prior to the other facility making such repair(s): 1) you notify the Dealership’s Service Manager that the Vehicle cannot be returned to the Dealership for the required repairs; and 2) the Dealership’s Service Manager approves the repairs. If the Dealership’s Service Manager approves the repairs, the Dealership will not be liable for any costs associated with loss of use of the Vehicle including, but not limited to, costs for alternative transportation, meals and/or lodging.

NO WARRANTIES; NO INCIDENTAL AND CONSEQUENTIAL DAMAGES:

The Program described in this document does not create any express or implied warranties from the Dealership to you with respect to the Vehicle or the Covered Services. Your sole right under this Program is to receive repair or replacement of nonconforming goods or parts that are covered by the Program. This Dealership is not liable to anyone for loss of use of the Vehicle; lost profits; any incidental, indirect, consequential, special, punitive or exemplary damages; and/or attorney’s fees and costs of litigation, regardless of the theory of liability.
